By requesting a quotation, making a payment, signing a proposal, or using our website or services, you agree to be legally bound by these Terms & Conditions.
Quotations & Pricing
All quotations are valid for 30 days unless otherwise stated.
Prices are subject to change before payment is received.
Additional work requested outside the agreed project scope will attract additional charges.
Payments
Projects may require an upfront deposit before work begins.
The remaining balance must be paid according to the agreed payment schedule.
Lumigrow reserves the right to suspend work on any project with overdue payments until outstanding balances are settled.
Ownership of completed work remains with Lumigrow until full payment has been received.
Client Responsibilities
The Client agrees to:
- Provide accurate project information.
- Supply all required text, images, logos, videos, and other materials promptly.
- Ensure all submitted content is owned or properly licensed.
- Review completed work and provide timely feedback.
- Respond to requests for information within a reasonable timeframe.
Project delays resulting from late client responses or missing materials may affect delivery timelines.
Project Timelines
Estimated delivery dates are provided in good faith and may vary depending on:
- Project complexity
- Client response time
- Approval delays
- Third-party services
- Technical requirements
- Force majeure events
Lumigrow will make every reasonable effort to deliver projects within agreed timelines.
Website Design & Development
Website projects commence once payment (or the agreed deposit) has been received and all required project materials have been provided.
Project timelines begin only after all necessary content has been submitted.
Any additional revisions beyond the agreed scope may incur additional charges.
Domain Names, Hosting & Third-Party Services
If Lumigrow registers a domain name, purchases hosting, SSL certificates, software licenses, premium themes, plugins, stock images, or other third-party services on behalf of the Client:
- These purchases are non-refundable.
- Ownership and renewal responsibilities will be communicated as agreed.
- Lumigrow is not responsible for pricing changes made by third-party providers.
Digital Marketing Services
Digital marketing results depend on multiple external factors including:
- Market competition
- Advertising budgets
- Search engine algorithm updates
- Audience behaviour
- Industry trends
- Platform policies
While we employ industry best practices, Lumigrow does not guarantee:
- First-page Google rankings
- Specific sales volumes
- Fixed lead numbers
- Advertising approval
- Revenue increases
Intellectual Property
Upon full payment, ownership of the final approved deliverables transfers to the Client unless otherwise agreed.
Lumigrow retains ownership of:
- Internal processes
- Development frameworks
- Proprietary tools
- Templates
- Source files not specifically included in the project agreement
We reserve the right to showcase completed work in our portfolio unless a written confidentiality agreement states otherwise.
Revisions
Projects include the number of revisions specified in the quotation or proposal.
Additional revisions or changes outside the agreed scope may require additional fees.
Refunds
Refunds are governed by our official Refund Policy.
By purchasing our services, you acknowledge that you have read and accepted our Refund Policy.
Cancellation
Either party may terminate a project by providing written notice.
The Client remains responsible for payment of work completed, consultations provided, third-party purchases, and expenses incurred before cancellation.
Limitation of Liability
To the fullest extent permitted by law, Lumigrow Marketing Solutions shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our services, including but not limited to loss of profits, business interruption, loss of data, or reputational damage.
Our total liability shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
Confidentiality
We respect the confidentiality of our clients’ information and will not disclose confidential business information to third parties except where required by law or with the Client’s consent.
Force Majeure
Lumigrow shall not be held responsible for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, internet outages, cyberattacks, government actions, labour disputes, pandemics, or failures of third-party service providers.
Privacy
Personal information collected through our website or during the course of providing services will be handled in accordance with our Privacy Policy.
Changes to These Terms
